THE late Vuyo Mbuli’s wife, Savita, has finally won her case against First National Bank (FNB).
Last week, Savita, who has been fighting with the bank over a house in Houghton, walked out of the South Gauteng High Court.
Sunday Sun has learnt she successfully interdicted FNB to stop it from auctioning the house.
The bank was forced by the court to cancel the scheduled auction of the Mbuli house in Houghton, in Jozi. Judge Wepener ordered the bank to stop the auction on Wednesday.
This after Savita had filed for an urgent interdict on Monday requesting the court to stop the planned sale.
The matter was set down for arguments on Tuesday and the ruling was handed down on Wednesday.
Savita was seen alone in court while the bank had brought a team consisting of lawyers and their internal team.
The court battle between Savita and the bank has dragged on for a while with many court appearances and arguments on facts and technicalities.
The bank first sued her for R10 260 000, but she defended it and applied for a rescission of the judgment. The bank admitted in a written affidavit it was a typo and the correct amount in question was R1 026 000.
On Thursday, a packed auction room in Braamfontein drew a lot of attention from the media and investors. But the investors left disappointed when they were informed the Mbuli house auction has been cancelled.
This week Savita said: “I did what I had to do to protect my kids. I can’t comment any further.”
FNB’s lawyers, Van Hulsteyns Attorneys, said they’ll respond to our questions on Friday, but did not at the time of going to print.
